Este trabalho tem por objetivo a compreensão da ação em Aristóteles. Para este fim será utilizado o livro III da Ética a Nicômaco, passando antes por uma breve definição da virtude, tal como aparece no livro II, a qual, pode-se dizer ser o bem para a ação, na medida em que é aquilo que se deve alcançar com ela. No campo específico da ação será visto como ela pode ser distinguida entre voluntária, involuntária e não-voluntária. Neste espectro insere-se igualmente a (...) discussão sobre o que significa agir por e na ignorância. Além disso, se abordará também a questão relacionada à deliberação e à escolha.: This study aims to understand the action in Aristotle. For this purpose, we will use the book III of the Nicomachean Ethics, after doing a brief definition of virtue, as it appears in the Book II, which can be said to be the good for the action, as that is what should be reached by her. In the specific field of action, it will be seen how she can be distinguished between voluntary, involuntary and non-voluntary. This spectrum is also part of the discussion about what it means to act by and in the ignorance. In addition, the study will also address the issue related to deliberation and choice. En este artículo, se abordará el concepto de mímesis, término de gran relevancia en la antigua Grecia, especialmente en el ámbito del arte, y que fue objeto de reflexión de destacados filósofos griegos, entre los cuales destaca Platón, quien ofreció una interpretación profunda y provocadora sobre la mímesisen su obra filosófica. En este análisis se mostrará que se trata de un término que se adapta a distintos contextos, lo que permite que se aplique de modos diversos. Tales aplicaciones posibilitan ver (...) que no se debe interpretar de un modo exclusivo, por ejemplo, al arte, porque sería reducir innecesariamente el significado del término.Para mostrar lo planteado, el artículo se divide en tres acápites: inicialmente se hará un análisis de la mímesisen el pensamiento presocrático, luego, se examinará el término en el libro II y III de La República, y, por último, se analizará y mostrará la evolucióndel término en La Repúblicadel filósofo ateniense y el porqué Platón considera, en el libro X, que la poesía mimética carece de valor de conocimiento. This paper concerns the Aristotelian inquiry on φαντασία’ in De Anima iii 3. I argue for a systematic interpretation of the chapter, according to which iii 3 neatly instantiates what David Charles has called the Three Stage View on scientific inquiry. The first stage establishes the meaning of the term φαντασία so it provides a nominal definition of the object, the second stage dialectically confirms the existence of φαντασία as something different from other already known cognitive powers (perception, thought), the (...) third stage posits a hypothetical essence (real definition), then it tests its power of enabling us to derive from such an essence those manifest and apparent features of φαντασία, that had been previously individuated. On the basis of such reading, some general suggestions on the status and role of φαντασία are also proposed, on the basis of which we can take the definition of iii 3 to be consistent with any other explanatory uses of φαντασία in the corpus. En este paper ofrezco una lectura global de _De Anima _III 4 de Aristóteles, en la que pretendo develar la rigu­rosa estructura argumentativa del capítulo. Así, mues­tro que el capítulo exhibe el típico patrón aristotélico de investigación filosófica: el estableci­mien­to de los pro­blemas básicos que han de ser resueltos, el camino dia­léctico para la postulación de una hipótesis, la deri­va­ción, a partir de ella, de las características indivi­dua­li­zantes relevantes del objeto (algunas de las cuales son ya manifiestas y explicadas _como_ (...) derivables de la hipó­tesis), y la emergencia de _aporiai_ que _prima_ _facie_ pare­cen invalidar la hipótesis pero que finalmente po­si­bili­tan una comprensión más profunda de ella. Pro­curo cla­rificar la progresión especulativa del capí­tu­lo al consi­derar incialmente el _Principio de Actuali­dad_ como sub­yacente a su _Modelo de Asimilación_ de la cog­nición (S conoce F _si y solo si_ el principio cognitivo de S deviene F debido a un objeto conocido O que es F en acto). Aristóteles, además, deriva la no-mezcla a partir de la carencia de límites (_Asunción de Ilimita__­ción_), que es una carac­terística manifiesta del _nous_. De la no-mezcla deriva la _Separabilidad_ (estas im­plica­cio­nes se clarifican en la primera _aporia_), de la Se­pa­rabi­li­dad deriva la _Espontaneidad_ y de la Esponta­neidad la _Autointelección_ del _nous_ (clarificada en la segunda _aporia_). VI. 4 y _De An._ III. 6) en estrecha vinculación con la aprehensión intelectual como proceso cognitivo y con la naturaleza del objeto inteligible. Partiendo de la hipótesis de que Aristóteles extiende la noción de falsedad del ámbito proposicional al ámbito de los ítems simples, nuestra reconstrucción interpretativa ofrece una visión de (...) conjunto de estas tres problemáticas. One of the most important contributions of Einstein to the philosophy of science is the distinction between two types of scientific theories: ‘principle’ and ‘constructive’ theories. More recently, Flores proposed a more general distinction, classifying scientific theories by their functional role into ‘framework’ and ‘interaction’ theories, attempting to solve some inadequacies in Einstein’s proposal. Here, based on an epistemic criterion, we present a generalised distinction which is an improvement over Flores approach. In this work (i) we evaluate the shortcomings related (...) to Flores’s proposal, (ii) we present an epistemological criterion that opens the door for a more general classification of any scientific theory in all of the natural science into two distinct groups, which we call ‘mechanistic theories’ and ‘structural theories’, and (iii) we show that such a criterion is connected to Flores’ proposal while overcoming issues of all previous approaches. Power-law city-size distributions are a statistical regularity researched in many countries and urban systems. In this history of science treatise we reconsider Felix Auerbach’s paper published in 1913. We reviewed his analysis and found (i) that a constant absolute concentration, as introduced by him, is equivalent to a power-law distribution with exponent $$\approx 1$$ ≈ 1, (ii) that Auerbach describes this equivalence, and (iii) that Auerbach also pioneered the empirical analysis of city-size distributions across countries, regions, and time periods. We (...) further investigate his legacy as reflected in citations and find that important follow-up work, e.g. by Lotka (Elements of physical biology. Williams & Wilkins Company, Baltimore, 1925) and Zipf (Human behavior and the principle of least effort: an introduction to human ecology, Martino Publishing, Manfield Centre, CT (2012), 1949), does give proper reference to his discovery—but others do not. For example, only approximately 20% of city-related works citing Zipf (1949) also cite Auerbach (Petermanns Geogr Mitteilungen 59(74):74–76, 1913). To our best knowledge, Lotka (1925) was the first to describe the power-law rank-size rule as it is analyzed today. Saibante (Metron Rivista Internazionale di Statistica 7(2):53–99, 1928), building on Auerbach and Lotka, investigated the power-law rank-size rule across countries, regions, and time periods. Zipf’s achievement was to embed these findings in his monumental 1949 book. We suggest that the use of “Auerbach–Lotka–Zipf law” (or “ALZ-law”) is more appropriate than “Zipf’s law for cities”, which also avoids confusion with Zipf’s law for word frequency. This paper presents an experimental study investigating artificial grammar learning (AGL) in monolingual and bilingual children, with and without dyslexia, using an original methodology. We administered a serial reaction time (SRT) task, in the form of a modified Simon task, in which the sequence of the stimuli was manipulated according to the rules of a simple Lindenmayer grammar (more specifically, a Fibonacci grammar). By ensuring that the subjects focused on the correct response execution at the motor stage in presence of (...) congruent or incongruent visual stimuli, we could meet the two fundamental criteria for implicit learning: the absence of an intention to learn and the lack of awareness at the level of resulting knowledge. The participants of our studies were four groups of 10-year-old children: 30 Italian monolingual typically developing children, 30 bilingual typically developing children with Italian L2, 24 Italian monolingual dyslexic children and 24 bilingual dyslexic children with Italian L2. Participants were administered the modified Simon task developed according to the rules of the Fibonacci grammar and tested with respect to the implicit learning of three regularities: (i) a red is followed by a blue; (ii) a sequence of two blues is followed by a red and (iii) a blue can be followed either by a red or by a blue. Results clearly support the hypothesis that implicit learning took place, since participants of all groups became increasingly sensitive to the structure of the input, implicitly learning the sequence of the trials and thus appropriately predicting the occurrence of the relevant items, as manifested by faster reaction times in predictable trials. Moreover, group differences were found, with bilinguals being overall faster than monolinguals and dyslexics less accurate than controls. Finally, an advantage of bilingualism in dyslexia was found, with bilingual dyslexics performing consistently better than monolingual dyslexics and, in some conditions, at the level of the two control groups. These results are taken to suggest that bilingualism should be supported also among linguistically impaired individuals. (shrink)

Chapter VI discusses a few assumptions which underlie the proposed reconstruction of Hegel's procedures. It is shown that certain equivalents of such assumptions are either explicitly accepted by Hegel, or they are consequences of theses he subscribed to. Finally, it is suggested that some of these assumptions envisage a conception of language and philosophy which has an interesting parallel in Wittgenstein's later work. Such a conception sets philosophy sharply apart from the sciences, and deemphasizes the formation of contradictions. The general (...) relationship between vagueness and contradiction is briefly explored to show that some familiar contradiction-generating procedures can be seen to be based on vagueness of the relevant theoretical expressions. ;Chapter V deals with the Aufhebung. After an examination of Hegel's own theory of sublation, and an analysis of some textual examples, it is shown that some Aufhebung-procedures can be modelled by certain patterns of argument concerning simple algebraic structures. A few Hegelian concepts, such as "opposition," "unity," "passing over," "reflection," are partially explicated in the process. ;Chapter IV plays a pivotal role in the dissertation. It explains the generation of dialectical contradictions as stemming from syntactic and intensional indeterminacy of the theoretical terms. It is shown that Hegel's conceptual terms have no well-determined sense, so that their senses can be identified in different and possibly inconsistent ways. It is also shown that they can be made to play different syntactic roles, for no rigid determination of their syntactic function is assumed. This, again, may create contradictions. Both kinds of indeterminacy are related to Hegel's borrowing of his conceptual terms from a "natural" philosophical koine. ;Chapter III is an analysis of Hegel's language in the Logic. It tries to determine the grammatical and semantical status of Hegel's conceptual terms and to explicate the Hegelian use of the copula as occurring in certain typical sentential forms. ;The presence of the so-called "dialectical contradictions" is the most evident logico-linguistic peculiarity of Hegel's text. After a discussion of Hegel's theory of contradiction, and of some of its interpretations, it is argued that any satisfactory account of the dialectical method must explain the formation of contradictions on the basis of other logico-linguistic features of Hegel's text. ;Chapter II deals with a few such explanations which have been offered by modern interpreters of Hegel. Use of contemporary analytic concepts in the logical and linguistic analysis of Hegel's text is justified with reference to the Carnapian categories of "explication" and "rational reconstruction." ;The literature on Hegel's dialectic has made important contributions to an understanding of its nature both as a metaphysical theory of reality and as a philosophical attitude towards the human world. However, many recent interpreters agree that no satisfactory progress has been made in understanding dialectic as a method. This dissertation identifies the dialectical method as the specific form of Hegel's philosophical discourse, and tries to bring out its basic logico-linguistic features. The Science of Logic is chosen as the field of inquiry, because of its crucial position among Hegel's mature works. (shrink)

El concepto de trastorno mental permite justificar intervenciones médicas, psicológicas y judiciales. Además, facilita a la/el consultante acceder a tratamientos mediante reembolsos o programas de salud pública, y por otro lado, podría conllevar estereotipos sociales. No obstante, el significado de dicho concepto no ha dejado de suscitar debate. En el presente artículo argumentaré que los trastornos de personalidad, tal como son definidos en el DSM-5, no cumplen con los criterios de patología de las propuestas principales (i.e. teoría bio-estadística de la (...) salud, disfunción dañina, o entidad patológica) debido a tres razones independientes: (i) no se han propuesto dis/funciones a la base de cada trastorno y, dado el estado del arte de la psicología evolucionista, es poco probable que se pueda llevar a cabo ese programa en el futuro; (ii) el concepto de daño (distrés, perjuicio) aplicable a los trastornos de personalidad es constitutivamente social (aunque no exclusivamente social), por lo que resulta más adecuado hablar de grados de discapacidad que de trastornos del individuo; y (iii) que la ausencia de condiciones patognomónicas para cada trastorno, junto a la elevada comorbilidad y multimorbilidad entre trastornos de personalidad, horada la validez de la nosología actual y de los diagnósticos diferenciales. Propondré como solución la eliminación de los trastornos de personalidad de la nosología psiquiátrica. Eliminar los trastornos de personalidad no equivale a desconocer el sufrimiento de las personas diagnosticadas, ni a ignorar que dicho sufrimiento precede a, –y no acaba con la disolución de– la etiqueta diagnóstica. Por ello, se propondrá una reconceptualización de dicho sufrimiento en términos de discapacidad, entendida desde el modelo social, y que no presupone patología. (shrink)

In this paper, the author reproduces one of Nicolas Malebranche’s arguments for God’s existence. The text offers (I) a logical formalization of the argument, (II) a formal proof of validity of the argument and, finally, some philosophical reflections concerning not only (III.I) the soundness of the argument, but (III.II) the intellectual benefits that a logical formalization offers to a philosophical historian of philosophy.

Aplico la noción a dos disputas distantes en el tiempo para esclarecer su parentesco: la controversia que sostuvieron platónicos y aristotélicos entre los siglos iii a. c. y iii (...) d. c. sobre el modo de existencia del infinito, y la controversia que sostuvieron Georg Cantor y Leopold Kronecker a finales del siglo xix sobre la legitimidad de los números transfinitos. The article argues that Plato's Laws contain an implicit conception of freedom, particularly in Book III. It proposes that, while the concept is not treated systematically by Plato, it merits attention due to its presence in the text. I argue that there is a Form of Freedom in the book. It is comprised of two dimensions: an organic and a civic component. They are mediated by human agency. However, freedom in its ideal form is only possible for a select intellectual (...) elite that can grasp these two dimensions. This elite is composed of a few wise elder men who take up the task of lawmaking as a ludic or playful enterprise. I also argue that degeneration away from true freedom is possible when political elites mislead a community away from Plato's ideal, such as with Cyrus in Persia. Ultimately, Plato's idea of freedom tells us that liberty is only truly available to a select few, not to a broad citizenry. Thus, freedom and democracy are not tied intimately but are opposed to each other. (shrink)

This article examines the conceptualisation of corporate social responsibility (CSR) in the context of mining multinationals (MNCs) in Argentina. It explores the suitability of CSR for addressing social, environmental and economic issues associated with mining in the country. The study is based on interviews with four stakeholder groups in the country: government, civil society, international financial organisations, and mining industry. These are analysed using content and interpretative techniques and supplemented by the content analysis of secondary data from headquarters of mining (...) MNCs. Using the concept of corporate social responsibility orientation (CSRO), the study contrasts the perceptions of major stakeholders and examines adaptation of mining companies’ CSRO to local context. It reveals that the CSRO of mining managers in Argentina differs from CSRO developed by global headquarters; and in Argentina companies “negotiate” economic, environmental and legal dimensions of CSR with the government. Although companies “negotiate” philanthropic responsibilities with the communities, ethical responsibilities are defined by the headquarters and not negotiated locally. The analysis suggests that environmental duties are the critical element of CSR in the mining sector in Argentina. This study treats environment as a separate dimension of corporate responsibility defined as to do “what is safe for the environment”. (shrink)

Durante la última década del siglo XX y los primeros años del nuevo milenio, las instituciones públicas y/o de gobierno han pasado por un proceso de ajuste y cambio debido al arribo de las técnicas gerenciales provenientes del sector privado conocidas como Nueva Gestión Pública. Dichas técnicas han generado, por un lado, una modificación sustantiva en la forma de organizar, estructurar y operar los servicios públicos y, por otro, algunos cambios en la conducta de los servidores públicos pero desviándose de (...) la esencia de servicio público original. In this paper, I critically engage with Casey Perin's interpretation of Sextan Pyrrhonism in his book, The Demands of Reason: An Essay on Pyrrhonian Scepticism. From an approach that is both exegetical and systematic, I explore a number of issues concerning the Pyrrhonist's inquiry into truth, his alleged commitment to the canons of rationality, and his response to the apraxia objection.

People tend to overestimate emotional responses to future events. This study examined whether such affective forecasting errors occur for feelings of regret, as measured by self-report and subsequent decision-making. Some participants played a pricing game and lost by a narrow or wide margin, while others were asked to imagine losing by such margins. Participants who experienced a narrow loss reported more regret than those who imagined a narrow loss. Furthermore, those experiencing a narrow loss behaved more cautiously in a subsequent (...) gambling task. Thus, the study provides self-report and behavioral evidence for a reversal of the affective forecasting phenomenon for feelings of regret. (shrink)

We study the possible values of the cofinality invariant for various Borel ideals on the natural numbers. We introduce the notions of a fragmented and gradually fragmented ideal and prove a dichotomy for fragmented ideals. We show that every gradually fragmented ideal has cofinality consistently strictly smaller than the cardinal invariant and produce a model where there are uncountably many pairwise distinct cofinalities of gradually fragmented ideals.

Morphological EvoDevo is a field of biological inquiry in which explicit relations between evolutionary patterns and growth or morphogenetic processes are made. Historically, morphological EvoDevo results from the coming together of several traditions, notably Naturphilosophie, embryology, the study of heterochrony, and developmental constraints. A special feature binding different approaches to morphological EvoDevo is the use of formalisms and mathematical models. Here we will introduce anatomical network analysis, a new approach centered on connectivity patterns formed by anatomical parts, with its own (...) concepts and tools specifically designed for the study of morphological EvoDevo questions. Riedl’s concept of burden is tightly related to the use of anatomical networks, providing a nexus between the evolutionary patterns and the structural constraints that shape them. (shrink)

Microbes can influence host physiology and behavior in many ways. Here we review evidence suggesting that some microbes can contribute to host stress (and other microbes can contribute to increased resilience to stress). We explain how certain microbes, which we call “stress microbes,” can potentially benefit evolutionarily from inducing stress in a host, gaining access to host resources that can help fuel rapid microbial replication by increasing glucose levels in the blood, increasing intestinal permeability, and suppressing the immune system. Other (...) microbes, which we term “resilience microbes,” can potentially benefit from making hosts more resilient to stress. We hypothesize that “stress microbes” use a fast life history strategy involving greater host exploitation while “resilience microbes” use a slow life history strategy characterized by more aligned evolutionary interests with the host. In this paper, we review the evidence that microbes affect host stress and explain the evolutionary pressures that could lead microbes to manipulate host stress, discuss the physiological mechanisms that are known to be involved in both stress and microbial activity, and provide some testable predictions that follow from this hypothesis. l nostro obiettivo è di rintracciare l'origine dell'autocoscienza attraverso una indagine filosofica che, a partire dalle ricerche di Darwin, segue il filo che lega lo scienziato inglese alle concezioni pragmatiste sviluppate da Mead e Wright, i quali hanno messo in evidenza alcuni aspetti chiave che sviluppiamo poi in una ricostruzione sistematica e genealogica condotta con l'aiuto della fenomenologia classica e della filosofia di Carlo Sini.

Movies can serve valuable didactic purposes teaching clinical ethics to medical students. However, using film sequences as means to develop critical thinking is not a straightforward task. There is a significant gap in the literature regarding how to analyse the ethical content embedded in these clips systematically, in a way that facilitates the students’ transition from anecdotal reflections to abstract thinking. This article offers a pedagogical proposal to approach the ethical analysis of film sequences in a systematic fashion. This structured (...) stepwise method encourages students to identify the main ethical problem of a selected scene and to reflect on the theoretical principles involved, emphasizing the application of these norms and values in a contextually situated analysis. We believe this method in film studies both reinforces the students’ comprehension of the theoretical framework of an ethical topic, and casts light on its pertinence and limitations under the circumstances of the scene, thus proving a constructive tool to strengthen the bridge between the theoretical teaching of clinical ethics and clinical practice. Introduction: Clinical policies control several aspects of clinical practice, including individual treatment and care, resource management and healthcare professionals’ etiquette. This article presents Clinical Policy Ethics Assessment Tool, an ethical assessment tool for clinical policies that could be used not only by clinical ethics committees but also by policy committees or other relevant groups. Aim: The aim of this study was to find or create a tool to identify ethical issues and/or confirm ethical validity in nursing practice policies, protocols and (...) guidelines. Methodology: The development of Clinical Policy Ethics Assessment Tool involved first a literature review, followed by modification of the Research Protocol Ethics Assessment Tool, which was created to identify research protocols’ ethical issues, and finally, a trial of Clinical Policy Ethics Assessment Tool to ensure its reliability and validity. Ethical consideration: The policies analysed trialling Clinical Policy Ethics Assessment Tool were in the public domain and did not contain any confidential information. Despite that, Clinical Policy Ethics Assessment Tool also had the approval of a research ethics committee. Results: Research Protocol Ethics Assessment Tool was chosen as the template for a Clinical Policy Ethics Assessment Tool, to which several modifications were added to adapt it to work within a nursing practice context. Clinical Policy Ethics Assessment Tool was tested twice, which resulted in a general test–retest reliability coefficient = 0.86, r = 0.84, α1 = 0.817, α2 = 0.824 and interclass correlation coefficient = 0.874. Discussion: Contemporary nursing practice in a developed country is often ruled by clinical policies. The use of Clinical Policy Ethics Assessment Tool could confirm the ethical validity of those clinical practice policies, impacting on nurses’ education, values and quality of care. Conclusion: Clinical Policy Ethics Assessment Tool has the potential to detect ethical issues and facilitate the correction and improvement of clinical policies and guidelines in a structured way. This is especially so as it has shown reliability in detecting issues in clinical policies involving human participants and in encouraging policymakers to consider common ethical dilemmas in nursing practice. One of Heidegger’s most important descriptions of bodily existence can be found in his Nietzsche lectures. This paper aims to elucidate this “metaphysics of the body” both in relation to Heidegger’s Leibniz-interpretation in the later Marburg lectures as well as in the context of his later thought. Leibniz and Nietzsche are Heidegger’s points of departure in the attempt to think the difference between θεωρία and πραξις beyond Being and Time: It is only by understanding their relationship, through a radical re-thinking (...) of the problem of corporeality, no longer as a noun (der Leib) but as a verb (leiben), that one can possibly move beyond every traditional dualism, between theory and praxis but also and most notably between being and becoming. We give a short proof of the fundamental theorem of central element theory. The original proof is constructive and very involved and relies strongly on the fact that the class be a variety. Here we give a more direct nonconstructive proof which applies for the more general case of a first-order class which is both closed under the formation of direct products and direct factors.

En La enfermedad mortal Anti-Climacus describe enfáticamente la desesperación como la consecuencia de la negación de la posibilidad producida por el deseo humano cuando este insiste en ser sí mismo u otro sin Dios. Esta negación genera una relación no efectiva del individuo consigo mismo y con los otros, dando lugar a la condición del pecado, entendido en su connotación religiosa. Lo anterior conduce al problema de cómo llegar a ser un verdadero cristiano en el marco de una crítica, realizada (...) frecuentemente por el pensador danés, del egoísmo moderno. En el siguiente artículo realizaré un análisis hermenéutico de la desesperación considerando el contexto de la objetividad moderna, en contraposición al concepto del amor planteado por Kierkegaard como un proyecto ético-existencial en Las obras del amor. It is generally agreed that one of the key differences between ancient skepticism and modern and contemporary skepticism is that the ancient skeptic does not call into question the existence of the external world, but only our ability to know the properties or qualities of external objects. In this paper, I argue that in Sextus Empiricus's attack on the Epicurean criterion of truth one finds evidence that the ancient Pyrrhonist also suspends judgment about the existence of external objects.

Pyrrhonism can safely be said to be the most prominent and influential form of skepticism in the history of Western philosophy. It was an important philosophical movement in the Hellenistic and Imperial ages, made a tremendous impact on modern philosophy, and some of its arguments continue to be a central topic of discussion in the contemporary philosophical scene. This can be taken to be a strong indication of the intriguing and challenging character of the Pyrrhonian outlook. After presenting the collections (...) entirely or primarily devoted to ancient Pyrrhonism and its presence in, or connection with, both modern and contemporary philosophy, this article deals consecutively with Pyrrhonian skepticism in the three historical periods. The reason for not including a part on Pyrrhonism in medieval philosophy is simply that knowledge of this type of skepticism was so limited in the Middle Ages that it exerted almost no influence whatsoever on medieval thinkers. Given that Pyrrhonian skepticism is essentially an ancient philosophy, the great majority of the citations concern ancient Pyrrhonism. Este artigo traduz a discussão que vem sendo construída sobre a indumentária étnica, especificamente de matriz afro-brasileira. Para tal narrativa, a temática envereda-se em apresentar alguns artefatos pertencentes à Coleção Perseverança: faixa, peitoral, coroa capacete, pulseiras e bolsas. Esta pesquisa seleciona, dentre as 215 peças da coleção, os adornos utilizados nos terreiros de Xangôs do estado de Alagoas. É importante entendermos que os artefatos selecionados representam a memória do “Quebra do Xangô”, em 1912, ato conhecido como a invasão e destruição (...) de todos os terreiros nas cidades alagoanas, principalmente a capital Maceió. A Perseverança nasce nesse contexto, representando, além do fato que lhe deu origem, a cultura africana presente no estado. El propósito de este trabajo es explorar la relación entre el principio de eficacia y el imperio de la ley como formalidad legal. Parte sustancial del trabajo se dedica a reconstruir el fundamento que se atribuye a cada noción en las teorías jurídicas preponderantes y cómo se relacionan con el concepto de derecho y con la existencia de los sistemas jurídicos. Este examen muestra que el imperio de la ley como formalidad legal y el principio de eficacia comparten un mismo (...) fundamento, lo que permite trazar ciertas relaciones entre ellas. Los principales resultados de este análisis son dos. Primero, no existe una determinación unánime acerca de la relación entre el principio de eficacia y el imperio de la ley como formalidad legal con el concepto de derecho y con las condiciones de existencia de los sistemas jurídicos. Segundo, dos de las posiciones que mayor influjo ejercen en la literatura acerca de la relación entre ambas nociones, presentes en los trabajos de M. Kramer y J. Raz, tienen problemas importantes.
